SugarGlitch — Underage Policy

This Underage Policy is published by SugarGlitch Ltd, a Cyprus private limited company ("SugarGlitch," "we," "our," or "us"), and is incorporated into our Terms of Service.
SugarGlitch takes the protection of minors seriously. The Services include AI-generated content, some of which is adult in nature and intended for users 18 and older only. This Policy describes our age requirements, how we enforce them, and how we respond when we believe a user has not met them.
This Policy works alongside our Terms of Service, Privacy Policy, Prohibited Content Policy, Content Moderation Policy, and Content Removal Policy. Where this Policy and another policy address the same topic, both apply, with the more restrictive provision controlling for safety-related matters involving minors.
1. Age Requirements
The Services have a tiered age structure:
- Under 13. The Services are not available to anyone under the age of 13. We do not knowingly collect personal information from children under 13.
- 13 to 17. Users between 13 and 17 may use the Services, but only the portions classified as Safe-for-Work ("SFW"). Users in this age range must not access, generate, request, or attempt to access content classified as Not-Safe-for-Work ("NSFW").
- 18 and older. Users who are at least 18 years of age (or the legal age of majority in their jurisdiction, whichever is higher) may access NSFW content, subject to the rest of this Policy and applicable law.
Where local law sets a higher minimum age for any aspect of the Services — including the minimum age for adult content — the higher local age applies.
Where local law requires verifiable parental consent for data processing of users below a specified age (for example, age 13 in the United States under the Children's Online Privacy Protection Act, and ages 13 to 16 in EU member states under the GDPR), users below that age must obtain such consent before using the Services.
2. Registration and Age Gating
When you register for the Services, you must affirm that you are at least 13 years old. To access NSFW content, you must additionally affirm that you are at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher) and enable the NSFW setting in your account preferences. Enabling NSFW access is gated by a modal that requires you to explicitly confirm your age and acknowledge that you are about to view adult content.
Providing false age information is a violation of our Terms of Service and may result in immediate termination of your account.
Additional verification. Where required by applicable law, payment partner requirements, regulator guidance, or our own risk assessments, we may apply additional age or identity verification measures. Depending on your jurisdiction, this may include third-party age-verification services, government-issued identification checks, facial or biometric age estimation, or other approved methods. We may decline to provide access to NSFW content, or to the Services as a whole, where verification cannot be completed.
You are responsible for ensuring that your access to the Services complies with all laws applicable to you, including laws governing your minimum age for adult content and for data processing.
3. SFW / NSFW Classification
Content on the Services is classified as SFW or NSFW using a combination of automated systems and, where applicable, human review. NSFW content is hidden from users who have not enabled NSFW access in their account settings, and is hidden by default from users who are not eligible to enable that setting.
Limitations of classification. Automated classification is not perfect. Some Content may be misclassified — either as NSFW when it is not, or (more importantly) as SFW when it should be NSFW. We continuously work to improve our classification systems. If you encounter Content that you believe is misclassified, please report it to [email protected] with the subject line "Misclassification Report."
Continuing duty of users. A user's age and the SFW/NSFW classification system are independent layers of protection. Even if a piece of Content is incorrectly classified as SFW, users between 13 and 17 must not knowingly access, request, or generate adult Content. Doing so violates these Terms regardless of how the Content was classified.
4. Generation of Content Depicting Minors
Generating, requesting, or sharing Content that sexualizes any minor — or any character or persona that appears to be a minor — is strictly prohibited under our Prohibited Content Policy. This prohibition applies to all users regardless of age, and applies to AI-generated, animated, illustrated, written, "aged-up," or otherwise stylized depictions of minors.
We use dedicated detection systems aimed at preventing the creation of such Content, with strict thresholds and a low tolerance for false negatives. Violations are removed immediately, accounts are terminated, and where applicable we report to:
- The U.S. National Center for Missing & Exploited Children's CyberTipline
- INHOPE-affiliated hotlines and other competent authorities in the EU
- Other law enforcement and reporting bodies as required by applicable law
Attempting to circumvent these systems — through prompt manipulation, jailbreak techniques, euphemism, or otherwise — is itself a violation and may result in the same consequences.
5. Suspected Underage Users
If we have reason to believe that a user is under 13, or that a user between 13 and 17 has accessed or attempted to access NSFW content, we may, in addition to any other remedies:
- Suspend or terminate the account, with or without prior notice
- Remove or restrict access to associated Content
- Delete the user's personal information to the extent required by applicable law (including COPPA, where applicable)
- Reject future registration attempts associated with the same user
- Report the matter to law enforcement where required, particularly in cases involving suspected exploitation
Where a user provided false age information at registration, we may also pursue any other remedies available under our Terms of Service and applicable law.
6. Reporting Underage Users
If you believe a user of the Services is under 13, or is between 13 and 17 and accessing NSFW content, please report this to us at [email protected] with the subject line "Underage User Report." Please include any information that helps us identify the account, such as the username or profile URL, and the basis for your belief.
We treat these reports as a priority and act on them promptly. We treat them confidentially and do not disclose the identity of the reporter to the affected user without consent or legal requirement.
7. Information for Parents and Guardians
If you are a parent or guardian and believe your child has registered for or used the Services in a manner inconsistent with this Policy, please contact us at [email protected] with the subject line "Parental Request." We will work with you to address the situation, which may include closing the account and deleting the associated personal information to the extent required by applicable law.

8. Updates
We may update this Policy from time to time to reflect changes in law, our practices, or the features of the Services. We will indicate the date of the most recent update at the top of this Policy.
